In the event of a dispute

Any claim, complaint or grievance shall be addressed to the registered office of the Circuit.


 


Applicable law and jurisdiction

These provisions shall be governed, interpreted and enforced in accordance with Belgian law, which shall be the only applicable law in the event of a dispute.


Any dispute that cannot be settled amicably within a period not exceeding one month from the date of its occurrence, which period may be extended by mutual agreement, may be brought by the most diligent party before the French-speaking Courts and Tribunals of the judicial district of Verviers, which shall have sole jurisdiction.

1) PROCESSING OF PERSONAL DATA OF USERS OF THE APPLICATION MADE AVAILABLE BY THE CIRCUIT


Le Circuit is committed to protecting and respecting your privacy. The data that you entrust to us and that you generate during your visit on our mobile application are essentially personal data. Le Circuit scrupulously complies with the applicable legislation in this area as in all others. Here is how:


WHY DO WE PROCESS YOUR DATA? DATA PROCESSING BY THE MOBILE APPLICATION


Installation through app stores The "Spa-Francorchamps" application is available in the following app stores (platforms offering applications managed by third parties): Google play and Itunes. The download of the mobile application may therefore be subject to registration with the app store. We have no influence on the processing of your data in connection with your registration and use of these app stores.


Content sharing via the mobile application


If the operating system (Android or iOS) you are using has a function to share application content, you can use this function on our mobile application via the Share or Recommend button to share or recommend products. Depending on the feature available on your operating system and the configuration of your device, you can use social networks to share content.


Geolocation


Our mobile application has certain features (e.g. "find your way around the circuit") that use the geolocation of your device to record geolocation data. This use of your data is intended to provide you with relevant services based on your location. We only collect this data with your consent, as you must authorise the mobile application to access the geolocation services. You can withdraw this consent at any time. We do not create a travel profile from this data.


Notifications


With your consent to enable these notifications, our mobile application can inform you of certain events or topics even when it is not open. It can run in the background and send you notifications, provided that Internet access is enabled and you are present on the Circuit site. If you no longer wish to receive such notifications, you can disable this option at any time by going to the notification settings of the mobile application.


Authorisations requested by the mobile application


In order for certain functions to work, our mobile application must be able to access certain interfaces and data on your device. Depending on the operating system you are using, this may require your express permission. Our mobile application requires the following permissions (if they are necessary for processing your data):


- Your geographical location (geolocation): This permission is required for the mobile application to access the geographical location determined by your device. - Notifications: this permission is required to activate the notification service of the mobile application;


- Access to your camera: permission is required for the mobile application to use the camera function of your device, to take pictures or to read a QR code. The mobile application can only access the camera if you select the corresponding function in the mobile application;

- Access to the storage space of your device: This authorisation is necessary to allow the mobile application to store data in the memory or, if applicable, in an auxiliary memory of your device or to read them. The mobile application will only read data stored in connection with its use. You can withdraw these authorisations at any time or adjust the authorisation settings in the system settings of your device.


2) PROCESSING OF PERSONAL DATA OF USERS OF THE CASHLESS SERVICE PROVIDED BY THE CIRCUIT


The Circuit is responsible for the processing of personal data collected in the framework of the Cashless Service. The Circuit de Spa-Francorchamps undertakes, in the implementation and operation of its Cashless Service as in any other activity of the Circuit, to protect and respect your privacy. This is how:


USE OF OUR CASHLESS SERVICES


Creation of the cashless account Purpose :


In order to use all the features offered by our Cashless Service, it is necessary for you to create an account on our Website or on our Mobile Application.


- If you have one or more cashless cards, you can link these cards to your account.


- If you have an account on the mobile application, this application will systematically provide you with a QR code allowing you to pay via the application. The data you provide when creating your cashless account is processed to give you access to our Cashless Service. This is essential to allow you to make your purchases on the Circuit website without having to use your bank card or cash.


Legal basis - The personal data processed is essential for the execution of the agreement to make the Cashless Service functionalities available through the creation of this personal account. The purchase of products on the Circuit's website is not conditional upon the use of the Cashless Service or the creation of a personal account since payments can also be made by bank card or cash or via a Cashless card issued by the Circuit but not linked to a personal account. Thus, the Cashless service is a facility offered to the Circuit's Clients. You freely decide to create such an account which implies the processing of your data by the Circuit.


Categories of data - This may include your full name, email address, username, password and possibly your cashless card number if you decide to link one or more cards to your account. All these data are essential. Without it, we cannot create an account for you or allow you to benefit from the features offered by that account. This data may be collected when you create your account on the Circuit website or mobile application. This data may also be collected when you contact us by e-mail, telephone or post regarding the cashless service.


Data recipients - Your data may be processed by our website host, our IT service provider and our payment service providers for the purposes strictly necessary to comply with the instructions we give them.


Duration - We are obliged to retain billing data until our tax and accounting obligations expire, which is 7 full fiscal years from the 1st January of the financial year following the date of purchase of our products or delivery of our services. Data may also be retained for 10 years for contractual liability purposes. Use of your Cashless account.


Categories of data - When your account is created and linked to a Cashless card where applicable, you will find your transaction history, your balance and your receipts. Purposes: We process this data in order to display it on your Cashless account. This is necessary to allow you to access all this information centrally. You can also request invoices for purchases made via the Cashless service via your account or deactivate your card in the event of loss or theft. We also process your data in order to respond to various enquiries sent to cashless@spa-francorchamps.be regarding any malfunctioning of the Cashless Service that you may experience.


Legal basis - The personal data processed for this purpose are essential for the performance of the agreement. In addition, the same data may be processed for the purpose of controlling the use of the account and preventing fraud. This purpose is based on the legitimate interest of the Circuit to prevent fraud.


Recipients of the data - This data may be passed on to the judicial authorities in the event of fraud or other offences. Your data may also be processed by subcontractors such as the host of our website, by the host and provider of our IT services and by several payment service providers, for the purposes strictly necessary to comply with the instructions we give them.

STATISTICS


The consumption data of Clients using the Cashless Service may be used by the Circuit for statistical purposes. In this case, the data is aggregated and anonymised and therefore no longer constitutes personal data.


WIFI


Purpose - Your personal data is processed to enable you to benefit from the wifi that we provide free of charge when you are on the Circuit site in order to display the Cashless QR Codes in the mobile application.


Legal basis - Our legitimate interest in protecting our computer network and cooperating with the judicial authorities allows us to process your data to secure the wifi connection provided and to store your connection data.


Categories of data - These are your name, first name, e-mail address, password and login data. Recipient of the data - Your login data may be passed on to the judicial authorities.


Duration - We keep your data for this purpose for a maximum of 6 months after your last connection to the wifi network provided.


Location - When you use the Cashless application and display QR codes, it is implicit that you are located on the Circuit. This is also the case if you use one of the kiosks located on the Circuit. However, the Circuit does not process this data for any purpose.


PROOF OF DELETION OF YOUR DATA


Purposes - When you exercise your right to deletion or request the deletion of your personal account on the website or on the application, the Circuit keeps the data necessary to prove that the deletion has taken place. This data retention is for evidentiary purposes only and contains only the data strictly necessary to establish proof of the deletion.


Legal basis - The retention of evidence of deletion is based on the legal obligation imposed by Article 5.2 of the GDPR, namely the duty of accountability. This provision is the basis for a legal obligation within the meaning of Article 17 of the RGPD which can justify an exception to the total erasure of data. The retention of this data is also justified by the legitimate interest of the Circuit in providing evidence of compliance with its legal obligations under the RGPD.


Data categories - These are your name, surname, deletion request, date of actual deletion and deletion logs of the data in the database.


Recipient of the data - The data in the deletion register is not passed on to any recipient other than the data protection supervisory authority. Duration - Your data will be retained for as long as the Circuit is liable for non-compliance with erasure requests, i.e. for a maximum of 10 years.


LOCATION OF YOUR DATA


In the European Union - Your data is in principle only stored on servers located in the EU.

Information - This right is exercised through this document. If the data processed includes the data of your staff, you undertake to make them aware of this document.


Access and rectification - You have the right to access your data and to have them rectified if necessary.
